My dear Sir,

In reference to your letter and my reply thereto; with reference also to your statement of my being appointed Chief Justice under the sanction of His Excellency the Governor; I beg to hand you a copy of the letter under which I hold that situation, as it is always quoted as the authority in the salary abstract for the payment of the salary assigned to it; and under it alone I received it.

I have further to add that I have mentioned the whole affair to the Hon. the late Chief Justice; who is of opinion that no resignation can be required of me, as suspension must necessarily include dismissal (or my own). Under these circumstances, with all deference, I trust my declining to send in a resignation will not be deemed contumacious.

I am, &c.,

(Signed) W. M. Rotter

Copy Enclosure in No. 6.

Victoria, Hongkong, 1st October, 1845.

Upon the strength of Mr. Shelley's recommendation, I appoint you my Clerk, at a salary of £300 per annum, subject to the approval of Her Majesty's Government.

Sir, Mr. W. M. Rotter,

Your &c., (Signed) John Walter Hulme, Chief Justice.

W. M. Colonial Secretary
